These Terms and Conditions apply to all roofing and related building services carried out by JW Roofing South West Ltd, registered in England and Wales and operating across Devon and the South West.
All quotations, estimates, and contracts are subject to the following Terms and Conditions. No other terms shall apply unless agreed in writing by a company director.
1. Quotations and Acceptance
a) All quotations are issued on the basis of these Terms and Conditions only. Work will not commence until acceptance has been received.
b) Acceptance may be given in writing, by email, or by payment of the agreed deposit.
c) Variations or additions to any order must be agreed with a director of JW Roofing South West Ltd and confirmed in writing.
2. Payments
a) Unless otherwise stated in writing, full payment is due within seven (7) days of the invoice date.
b) A maximum retention of £200.00 may be deducted unless otherwise agreed in writing before work commences.
c) The Contractor reserves the right to request payment in advance for materials and equipment. For all roofing contracts, JW Roofing South West Ltd may require a 50% deposit prior to the start of work or at any time before completion.
d) For contracts exceeding £2,000, stage payments may be required as detailed on the quotation or invoice.
e) Prices quoted are net and non-negotiable, inclusive of any contractor’s discount.
3. Overdue Payments
If payment has not been made by the due date, interest will be charged at HSBC Bank base rate + 8% until full payment is received.
4. Value Added Tax (VAT)
All prices are exclusive of VAT (unless otherwise stated). VAT will be charged at the current rate at the time of invoicing.
5. Quotations
a) All quotations remain open for 30 days from the date of issue unless otherwise stated.
b) Provisional sums are subject to adjustment once confirmed.
c) Emergency repairs and additional works, including the cost of materials, will be charged separately at the Contractor’s standard hourly rate unless otherwise agreed.
6. Consents and Approvals
The Client is solely responsible for obtaining all necessary planning permissions, building control approvals, and any other consents required for the works unless otherwise agreed in writing.
7. Timing and Delays
Any dates provided for the start or completion of works are for guidance only.
JW Roofing South West Ltd shall not be liable for delays caused by weather, material shortages, or other factors beyond our control. Any revised schedule will be provided as soon as practicable.
8. Measurements
If measurements are provided by the Client, JW Roofing South West Ltd reserves the right to amend the quotation if those measurements are found to be inaccurate.
9. Samples
Samples are provided as an indication of type and quality only. Exact matches in colour, size, or texture cannot be guaranteed.
10. Client Responsibilities
a) The Client must provide access to mains electricity, water, and toilet facilities on site.
b) The Client must notify utility providers of any cables, pipes, or services affected by the works.
c) Safe and adequate access to the work area must be ensured.
d) The Client must inform their property insurer that roofing works are taking place and maintain appropriate cover.
e) Any required access over neighbouring land or property must be arranged by the Client prior to work commencing.
f) The Client must coordinate with any other trades on site to avoid disruption or delay.
g) The Client must remove television aerials, satellite dishes, or other obstructions prior to works commencing (unless included in the quotation).
h) Materials delivered to site remain the responsibility of the Client to safeguard until installed.
i) If bats are present or suspected, the Client must notify the relevant wildlife authorities prior to the commencement of works.
11. Contractor Responsibilities
Where scaffolding or access equipment is required, JW Roofing South West Ltd shall ensure all such equipment complies with current Health & Safety and Construction Regulations.
Scaffolding erected by the Contractor must not be accessed or altered by the Client or any third party.
12. Materials on Site
a) Legal title to all materials supplied by JW Roofing South West Ltd remains with the Contractor until paid for in full.
b) All removed materials (including lead, slates, tiles, etc.) become the property of the Contractor unless otherwise agreed in writing.
c) The Contractor reserves the right to display temporary signage at the site for marketing purposes.
13. Waste Removal and Disposal
Unless otherwise stated in the quotation, JW Roofing South West Ltd will remove and responsibly dispose of all waste materials.
Additional charges may apply for skip hire or specialist waste removal (e.g. asbestos).
14. Health & Safety
The Client must ensure that the site is safe, clear, and accessible. The Contractor may withdraw staff if conditions are unsafe or non-compliant with Health & Safety regulations, or during adverse weather.
15. Dangerous or Hazardous Materials
If asbestos or other hazardous substances are discovered, all work will cease immediately.
The Client will be responsible for arranging a licensed asbestos contractor to remove such materials in accordance with the Control of Asbestos Regulations 2012.
16. Guarantees and Workmanship Warranty
JW Roofing South West Ltd guarantees that all work will be carried out with reasonable skill and care.

17. Liability and Claims
a) The Client is responsible for ensuring that the roof structure is sound and suitable for the proposed works.
b) JW Roofing South West Ltd shall not be liable for any damage to the internal or external fabric of the building, decoration, or contents unless caused by proven negligence.
c) The Contractor shall not be liable for any loss or damage resulting from force majeure events, including (but not limited to) extreme weather, strikes, fire, war, or material shortages.
d) The total liability of the Contractor shall not exceed the total contract value.
18. Insurance
JW Roofing South West Ltd holds full Public Liability Insurance and Employers’ Liability Insurance. Copies of certificates are available upon request.
19. Marketing and Photography
The Contractor may take photographs of the works for record-keeping and marketing purposes. No personal or identifying details of the Client or property address will be disclosed publicly.
20. Consumer Cancellation Rights
If the Client is a consumer (not a business), they have the right to cancel the contract within 14 days of acceptance in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Work will not commence within this period unless the Client provides written consent to waive the cancellation right.
21. Bankruptcy or Insolvency
In the event that the Client becomes insolvent, bankrupt, or enters administration, JW Roofing South West Ltd reserves the right to cease work immediately and cancel the contract without liability.
22. Dispute Resolution
Any dispute or difference arising under this agreement may be referred to adjudication in accordance with the Housing Grants, Construction and Regeneration Act 1996 and the Scheme for Construction Contracts 1998 (as amended).
Either party may apply to the President or Vice President of the Royal Institution of Chartered Surveyors (RICS) for the appointment of an adjudicator.
23. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
